Union Cabinet announces 8% DA hike to Central Govt. Emloyees and 8% DR to Central Pensioners

Dear Comrades,
Union Cabinet finally announced much awaited DA hike 8% to central Govt. Employees and 8% DR to the pensioners. Orders will be issued by the Finance Ministry with a day or two. The press release is as follows.

Release of additional instalment of Dearness Allowance to central government employees and Dearness Relief to pensioners, due from 1.1.2013

The Union Cabinet today gave its approval to release an additional instalment of Dearness Allowance (DA) to central government employees and Dearness Relief (DR) to pensioners with effect from 01.01.2013 at the rate of 8 percent over the existing rate of 72 percent.

Thus, the combined impact on the exchequer on account of both DA and DR would be of the order of Rs.8629.20 crore per annum and Rs. 10067.36 crore in the financial year 2013-14 (that is for a period of 14 months from January, 2013 to February, 2014). 

Filling up of HSG-I posts in Post Offices and RMS Offices-Directorate clarification

Dear Comrades,
Directorate vide Ofder No.04-44/2012-SPB-II dated 18/04/2013 ordered to fill up all HSG-I vacancies with existing Recruitment Rules. Circles are advised to convene DPCs for Promotion to HSG-I on regular basis latest by 30/04/2013 and issue the Promotion orders by 06/05/2013. The HSG-I posts may be filled up among the eligible HSG-II officials.

DELAY IN GRANT OF DA - HOLD PROTEST DEMONSTRATION ON 23RD APRIL 2013

            Since the implementation of the recommendations of the 4th central pay commission in 1986, the Dearness Allowance (DA) is paid in two six-monthly installments – in March and September of every year. The practice followed since then is that the order granting DA to government employees is issued in March and September itself.

            This time the practice in force since 1986 is violated. Our enquiries with concerned Ministries informed us that the file is already moved for Cabinet approval. But it is nearly a month now. The cabinet has found no time to take a decision on this.

            This naturally is quiet disturbing, especially in the time of galloping price line. The employees have, in the past, fought bitterly for grant of DA and the 3rd CPC gave a definite formula for DA in the aftermath of the one day strike on 19th September 1968. We cannot allow the hard won DA to be tampered with.

            Confederation has written to Prime Minister conveying the disquiet amongst the amongst the employees over the inordinate delay in the grant of additional installment of DA due from 1st January 2013 and urging the Prime Minister to take immediate steps to assuage the feelings of the employees. Copy of the letter is given along with this Circular.

            The Secretariat of Confederation therefore calls upon every affiliate as well as State Committee of Confederation to organise lunch hour demonstration in the work place on 23rd April 2013, Tuesday and send the following telegram to the Prime Minister of India.

            Text of Telegram: EMPLOYEES AGITATED OVER DELAY IN GRANT OF DA, URGE TO EXPEDITE ISSUANCE OF ORDERS.

            Each affiliate and State Committee of Confederation may send a detailed report on implementation of the programme in their organisation/state to the Confederation CHQ.

            Subject: Grant of Dearness Allowance to Central Govt Employees and Officers – Reg.
            I am to invite your kind attention to the delay in the grant of additional installment of Dearness Allowance to Central Government employees and officers and the consternation it is causing amongst the employees.
             It would be apt to point out here that since the implementation of the 4th CPC recommendations with effect from 1st January 1986, the Dearness Allowance is paid to Central Government employees in two six monthly installments – along with the salary for March and September every year. The 5th and 6th CPCs also recommended the same principle for payment of additional installments of DA and since then the order granting additional installment of Dearness Allowance is being issued well in advance honouring the recommendations.
            The Central Government Employees were expecting the announcement of grant of additional installment of Dearness Allowance (8 % with effect from 1st January 2013) and Office Memorandum on that in the month of March 2013 itself. The delay of more than a month has led to disquiet amongst the employees.
             I shall be thankful if the fears of the central government of employees are allayed by immediately releasing the additional instalment of Dearness Allowance with effect from 1st January 2013 without any further delay.

Items for Hyderabad Region


01-03/2013 : Finalisation of enquires in the fraud cases, in the region.

So many fraud cases were occurred in two to three divisions in this Region . The fraud cases were identified long back but enquiries were not completed by the Regional Administration though there are clear CVC guide lines as well as directorate guide lines in this regard. Because of non issuing of charge sheets and non finalisation of fraud cases, many employees are suffering in the name of subsidiary offenders. Even though the officials are not directly involved in the fraud cases, because of the non issuing of charge sheets and finalisation of the fraud cases, many employees were retired without getting their pensionary benefits. So enquires should be completed in the time frame.
02-03/2013: Sanction of S.B.Allowance to all ‘C’ class SPMs in MAhabubnagar Division

As per the CO lr.No. SB/1-4/89 dated 22/05/1989 in Para No.III S.B allowance to be sanctioned to the posts where the S.B.work load is 0.5 Rs.150 and where it is more than 0.5 Rs.300/- to be paid. But the SPOs Mahabubnagar Division has replied to the Item No.05/10-2012 that the single handed SPMs are not entitled for SB allowance. Hence it is requested to necessary instructions may be issued to the divisional head in this regard.
03-03/2013: Reopening of MPCM counter at Mahabubnagar HO

Recently MPCM counter and NSC counter discontinued at Mahabubnagar HO without taking the actual work load in to consideration. SPOs Mahabubnagar replied that the merger of the MPCM counter is taken place as per the visit report of the PMG Hyderabad Region which is highly irregular. Necessary action may be taken to reopening of MPCM counter at Mahabubnagar HO immediately

Subject: Ad-hoc Appointment/Promotion – Review of – Regarding.
The undersigned is directed to say that as per the extant policy of the Government, all posts are to be filled in accordance with provisions of the applicable Recruitment Rules/Service Rules. As explained in this Department’s O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 read with O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001,promotions/ appointments on ad- hoc basis are to be resorted to only in exceptional circumstances mentioned therein, to a post which cannot be kept vacant in consideration of its functional/operational requirement. In spite of these express provisions, it has come to the notice of this Department that the Ministries/Departments are resorting to ad-hoc arrangements in total disregard to the statutory provisions/instructions on the subject as well as proper manpower management and career advancement of the employees.
2. This Department has been impressing upon all the Ministries/ Departments from time to time to take adequate steps in advance so as to achieve the desired objective of timely convening of the Departmental Promotion Committee (DPC) meetings and preparing the approved select panels for regular appointments/promotions within the prescribed time limits. However, at many a time, due to non-adherence to the prescribed norms and procedures by the Ministries/Departments, the approved select panel is not ready in time and ad-hoc arrangements are resorted to. Some Ministries/Departments have taken non-acceptance of their incomplete proposals for DPCs, by the UPSC, as the reason for resorting to ad-hoc appointments. In this regard, as already emphasized in this Department’s O.M. No.22011/3/2011-Estt.(D) dated 24.03.2011, it is reiterated that the responsibility of sending the DPC proposals, complete in all respect, to the UPSC, lies entirely on the administrative Ministries/ Departments concerned.
3. Other reasons for resorting to ad-hoc arrangements are absence/revision of Recruitment Rules, disputed Seniority Lists etc. With regard to tackling the problem of absence of RRs, it may be pointed out that the OM No. AB 1401717912006-Estt. (RR) dated 6th September, 2007 provides that where no Recruitment Rules exist or where the existing Recruitment Rules are repealed as per the prescribed procedure, the option of approaching the UPSC for one time method would be available. These instructions further provide that it will not be feasible or advisable for the UPSC to suggest one time method of recruitment in cases where Recruitment Rules exist even if they are perceived as unworkable. In such situations, the administrative Ministries/Departments will have to process necessary amendments required in the Recruitment Rules and, thereafter, initiate therecruitment process.
4. Ad-hoc appointments/promotions should be made only in rare cases and for exigencies of work, where the post cannot be kept vacant until regular candidate becomes available. Persons appointed on ad-hoc basis to a grade are to be replaced by persons approved for regular appointment by direct recruitment, promotion or deputation, as the case may be, at the earliest opportunity. As already provided in this Department’s O.M. No.28036/1/2001- Estt.(D) dated 23.07.2001, no appointment shall be made on ad-hoc basis by direct recruitment from open market. Where the vacant post cannot be kept vacant for functional considerations, efforts are required to be made to entrust the additional charge of the post to a serving officer under provisions of FR-49, failing which only appointment by ad-hocpromotion/ad-hoc deputation is to be considered in terms of provisions of this Department’s O.M. No.28036/8/87-Estt.(D) dated 30.03.1988.
5. As already provided in this Department’s O.M. No.22011/3/75-Estt.(D) dated 29th October, 1975, and reiterated in O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 and O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001, an ad-hoc appointment does not bestow on the person a claim for regular appointment and the service rendered on ad-hoc basis in the grade concerned also does not count for the purpose of seniority in that grade and for eligibility for promotion to the next higher grade. As per existing provisions, these facts are to be clearly spelt out in the orders of the ad-hoc promotions/ ad-hoc appointments. Therefore, such ad-hoc arrangements are neither in the interest of the individuals nor the organizations concerned. It is, thus, not appropriate to resort to ad-hoc arrangements in a routine manner.
6. As per existing instructions vide O.M. No.2803618/87-Estt.(D) dated 30.03.1988 and O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001. the total period for which the appointment/ promotion may be made, on an ad-hoc basis, keeping in view the exceptionalities anticipated in these OMs, by the respective Ministries/ Departments, is limited to one year only. These instructions further provide that in case of compulsions for extending any ad-hoc appointment/promotion beyond one year, the approval of the Department of Personnel and Training is to be sought at least two months in advance before the expiry of the one year period. Also, if the approval of the Department of Personnel & Training to the continuance of the ad-hoc arrangement beyond one year is not received before the expiry of the one year period, the ad-hoc appointment/promotion shall automatically cease on the expiry of the one year term. Notwithstanding these provisions, instances have come to notice of thisDepartment where Ministries/j Departments have continued ad-hoc arrangements beyond one year without express approval of this Department, and later on, approached this Department to seek ex-post facto approval for continuation of such arrangements. It is reiterated that continuation of any ad-hoc arrangement beyond one year and release of pay and allowances for the same, without express approval of this Department is not in order.
7. This Department vide O.M. No.39036/0212007- Estt.(B) dated 14.11.2008, has requested all the Ministries/ Departments to comply with the regulation-4 of the UPSC (Exemption from Consultation) Regulations, 1958, which provide that if a temporary or officiating arrangement made by ad-hoc appointment to a post falling within the purview of UPSC is likely to continue for a period of more than one year from the date of appointment, the Commission shall immediately be consulted in regard to filling up of the post. For this purpose, the Ministries/Departments are required to furnish monthly and six-monthly returns to the Commission showing all such Group ‘A’ and ‘B’ Gazetted appointments and promotions made without reference to the Commission, as emphasized in this Department’s OM No. 39021/1/94-Estt.(B) dated 22.07.1994. These instructions are again reiterated and all the Ministries/Departments are requested to ensure that requisite returns are furnished to the Union Public Service Commission as per the time scheduleprescribed so as to effectively monitor the ad-hoc appointments being resorted to by various Ministries/Departments without consulting the UPSC.
8. All the administrative Ministries/Departments are requested to review the ad-hoc appointments/promotions made by them, from time to time, and at least once a year, on the basis of the guidelines and instructions in force, so as to bring down the instances of such ad-hoc manpower arrangements to the barest minimum, in respect of both Secretariat as well as non-Secretariat offices under them.

        De-quarterisation of Sanath Nagar PO in Hyderabad City Division.
        Sanath Nagar PO is HSG-I Post Office located in Industrial Area which is highly polluted. Even though it is big industrial area because of policies most of the industries are cut down their shifts in their production units, because of this the total industrial area become desert in the night time. In that situation the family members of the Postmaster feeling not only loneliness but also afraid to stay in that quarters. In this situation the quarter portion may be utilised for some other purpose by de-quarterizing the PO.
             The SSPOs, Hyderabad City Division has been requested to send the report on the observation of CIFA. Reply from SSPOs, Hyderabad City Division is awaited.

Supply of high power capacity Gen set to Secunderabad.HO.
           At present there are two gensets in Secunderabad. HO. which are not giving sufficient power supply to all branches. Hence it is requested to supply of High power capacity gen set to Secunderabad HO.
          The Chief Postmaster General has approved shifting of 15 KVA Genset of Humayun Nagar SO to Secunderabad HO.

AE (Elec) is requested to furnish estimates for installing the Genset, which are awaited. AE (Elec) is busy with Project Arrow works and at present there are no funds.

Drawl of HRA to SPM, Vuyyuru SO.
          The quarter portion of the Vuyyuru SO is consisting of two rooms. Out of two rooms one room is utilising for Railway reservation counter. Hence this union requests for dequarterisation of SPM quarter and issue necessary instructions to draw the HRA to the SPM.
          The PMG, Vijayawada has intimated that FRAC has been constituted for hiring of additional justified accommodation.

 EE (Civil) is busy with the Project Arrow works. After completion of this, he will attend to FRAC.

Regarding grant of HRA to SPM, the proposal received from PMG, Vijayawada will be examined.

Stop Harassment of SSPOs Ongole Division.
                Consequent up on Divisional level agitation programme, the SSPOs, Ongole division is harassing the members of AIPEU Group-C by issuing irregular transfers and issuing orders to union representatives to apply for leave to meet the SSPOs. Hence this union requests for issue necessary instructions to the SSPOs, Ongole division to stop harassment.

               It is to intimate that, after the agitation of Service Union, it is found that the SSPOs, Prakasam Division has made 4 transfers are at the request of the officials.
              As per the orders of RO, Vijayawada; SSPOs has transferred Sri B. Kondala Rao, DPM, Kandukur HO to Kanigiri HO in connection with the failure to take necessary action against absconders & for irregular drawal and disputed payment of allowances. This issue is under examination by RO, Vijayawada. No harassments are there in transfers.
              Regarding the orders issued to union representatives, to apply for leave to meet SSP, no harassment is there, as the same is as per the rules.

Immediate withdrawal of irregular punishments of union representatives issued by the SPOs, Hanamkonda Division for participating in the Dharna.
          SPOs, Hanamkonda Division issued irregular punishments to the union representatives enmass for participating in the Dharna. Hence this union requests for immediate withdrawal of irregular punishments of union representatives, issued by the SPOs, Hanamkonda Division for participating in the Dharna Programme.
                            
           Hyderabad RO has intimated that officials of Hanamkonda Division have preferred appeals to the Appellate Authority against the punishments awarded by the SPOs, Hanamkonda Division. The issue is still under examination of appellate authority.
