Clarification regarding fixation of Pay of re-employed ex-servicemen pensioners retiring before attaining age of 55 years and who hold post below commissioned officer rank in the Defense Forces.

D/o Posts may please refer to their proposal on preceding page seeking clarification regarding fixation of pay of re-employed/ex-servicemen pensioners retiring before attaining the age of 55 years, who held posts below commissioned officer rank in the Defence Forces and also whether the last pay drawn before retirement is subject to protection.

2. The. matter has been examined in this Department. It is pointed out that paras 4(a), 4(b)(i) and 4(d)(i) of DOS (Fixation of Pay of Re-employed Pensioners) Orders, 1986 as amended vide this Department’s OM. No.3/19/2009-Estt.(Pay.ll) dated 5.4.2010, provide that in case of ex-servicemen
who held post below Commissioned Officer rank in the Defence Forces and in the case of civilians who held posts below Group ‘A’ posts at the time of their retirement before 55 years of age, the entire pension and pension equivalent of retirement benefits shall be ignored, that is, no deduction on this count is to be made from the initial pay fixed on re-employment. Also, in terms Of the Para flin) of CCS (Fixation of Pay of Re-employed Pensioners) Orders, 1986, as amended vide this Department’s O.M. No.3/19/2009-Estt.(Pay.ll) dated 5.4.2010, the initial pay on re-employment shall be fixed as per the entry pay in the revised pay structure of the re-employed post applicable in the case of direct recruits appointed on or after 1.1 .2006. as notified vide Section II, Part A of First Schedule to CCS(Revised Pay) Rules, 2008. These instructions do not provide for protection of last pay drawn before retirement, in such cases.

Verification of qualifying service after 18 years service and 5 years before retirement.

                                                            OFFICE MEMORANDUM
 Sub: Verification of qualifying service after 18 years service and 5 years before retirement.
 It has been observed by this Department that processing of pension cases of the employees retiring from the government service quite often get delayed on account of the issues relating to verification of service from time to time by the concerned authorities during the service of the concerned employee. Although detailed instructions regarding verification of service have been issued by Department of Personnel & Training and by this Department, these instructions are not meticulously adhered to resulting in delay in sanctioning of retirement benefit of the employees. > 2. Rule 32 of the CCS (Pension) rules, which existed prior to December, 2012 provided for issuing of a certificate in Form 24 by the Head of Office in consultation with by the Account Officer regarding completion of qualifying service of 25 years. These rules have been amended subsequently and as per the existing provisions, a certificate regarding qualifying service is required to be issued by the HOO after completion of 18 years of service and again 5 years before the date of retirement of an employee. Rule further provide that verification done under that rule shall be treated as fmal and shall not be reopened except when necessitated by a subsequent -change in the rules and orders governing the conditions under which the service qualifies for pension. », 3. It has been noticed that the certificates regarding qualifying service are not invariably issued to the government servant as required under the rules. All Ministries! Departments etc. are therefore requested to bring these provisions to the notice of Heads of Offices and PAOs for strict compliance. Non-compliance of this statutory requirements may be viewed seriously. 4. In order to review status regarding compliance of these rules, all Ministries! Departments are requested that the information may be collected from all establishments loffice under them and the same may be compiled and sent to this Department by 15th October, 2015 in the enclosed proforma.

Im partance of 19th Sep in Central Govt Employees movement

On the eve of 19th September,2015 to commemorate the memory of 1968


" THE GRAVES OF THE MARTYRS HAVE GIVEN US A CALL,
ONLY THOSE, CAPABLE OF PLAYING WITH THEIR LIVES,
SHOULD COME FORWARD.
ON ONE SIDE ARE THE WORLDLY COMFORTS,
THE BLISS OF MARTYRDOM IS ON THE OTHER.
IT IS A BARGAIN, CHOOSE WHATEVER YOU MAY”.


 On 19 th September in 1968 our predecessors participated in Nation wide One Day’s strike. Most important demands were as follows:


CAUSE
EFFECT
Raise the increment rate.

Recognition of 205 unions were derecognised by The Govt. of India.
Need based minimum wage.

Death of 15 Strikers, Hundreds injured.
100% compensation for price rise.

1,00,000 temporary workers were dismissed from service.
Merger of DA with Basic Pay.

DA issue was referred to 3rd CPC and ultimately thereafter, a formula was decided.
Proposal for retirement after service up to 50 years of age /25 years of service to be scrubbed.  

10,000 workers were summarily dismissed from service.
Abolition of contractual and casual labourer system.

22,000 workers were arrested.


But they did not achieve any of the demands even after the Strike. But subsequently we achieved many of those demands after a long time and that is also at the cost of death and atrocities of our Central Govt. workers, which we are still enjoying. We salute those great comrades of ours who through the sacrifice of their lives on that auspicious day and on that historic occasion of 48th year of 19th September, 1968 Strike, have still been inspiring us.
 We pay our respectful homage to the memory of those martyrs who made the ultimate sacrifice for the great causes of ours and enabled us to breathe and live and grow as free and responsible workers with our heads held high with dignity.
It is necessary to realise the gains of our struggles, so dearly won, must be safe guarded, and safe guarded by our commitment to the great values.

Victimization figures in the P&T Strike in 1968 were as follows:

But the sprit of the Central Govt/ P&T workers could not be subdued by such atrocities and tortures as was evident from the strikes of 1974,1991,1993,1996,1998,2000,2008,2010,2012,2013 and 2014also.

The Nationwide strike of 2nd September, 2015 was  a historical step towards that direction.

            Accommodation to about 50 women delegates will be provided here. Meeting and dining will be at this venue. Accommodation to other delegates will be provided in the nearby.                As already intimated the two days All India Women’s Workshop will be held on 9th & 10th October 2015 (Friday & Saturday)at Hyderabad. The C-O-C Andhra & Telangana states has taken the task of hosting Women’s Workshop.  Preparatory work for making the event a grand success has already been started. Detailed programme & notice will be issued and published in our website shortly.  Women’s Workshop will commence at 10:30 AM on 09th October and conclude at 05:00 PM on 10th October. (Exact venue, place for stay etc. will also be intimated shortly).

          Delegates from all affiliated organisations and C-O-Cs should compulsorily attend the Women’s Workshop. The minimum quota fixed for each affiliated organisation and C-O-Cs is given below.  All are requested to ensure participation of delegates as per quota fixed, WITHOUT FAIL.  Delegates may be instructed to book their up and down tickets immediately.
  
Delegate fee per head is fixed as Rs.500/- (Rs. Five Hundred Only).
