Today Ministry of Finance, department of expenditure issued DA orders vide Memo No.1(2)/2011-E-II(B) dated 24/03/2011.The Payment of arrears of DA for the months of January and February 2011 shall not be made before the date of disbursement of salary of March 2011.

Take lenient view of suppression of information by job aspirant-In any event, it is not a serious offence, says Supreme Court

                            If a youth, by his act of indiscretion, fails to furnish a vital information required for employment out of fear that he will be disqualified, a lenient view must be taken by the authorities as it is not a serious offence, the Supreme court has held. A Bench of Justice Markandey katju and gyan sudha misra up held a Delhi High Court judgment declaring illegal the cancellation of an application of a youth for not disclosing his involvement in a criminal case, though he was acquitted in it. The Bench said “ The modern approach should be to reform a person instead of branding him a criminal all his life. When the incident happened, respondent Sandeep kumar must have been about 20 years of age. At that age young people often commit indiscretions, and such indiscretions can often be condoned. After all, youth will be youth. They are not expected to behave in as mature a manner as older people
                             The Bench referred to the character ‘Jean Valjean’ in Victor Hugo’s novel Les Miserables, in which for committing a minor offence of stealing a loaf of bread for his hungry family, Jean valjean was branded a thief for his whole life. In the instant case, in response to an advertisement issued in January 1999 for filling up of certain posts of Head Constables (Ministerial), the respondent applied on February 24,1999 but did not mention in his application form that he was involved in a criminal case. He qualified in all the tests. On April 3, 2001, he filled the attestation form wherein for the first time he disclosed that he was involved in a criminal case, which was compromised in 1998 and he was acquitted. His candidature was rejected for suppression of this information. While the Central Administrative Tribunal dismissed his plea, the High Court allowed his petition and held that cancellation of his candidature was illegal. The present appeal was filed by the commissioner of Police, delhi, against this judgment.
                            The Bench said “It is true that in the application form the respondent did not mention that he was involved in a criminal case. Probably he did not mention this out of fear that if he did so he would automatically be disqualified. At any event, it was not such a serious offence like murder,dacoity or rape, and hence a more lenient view should be taken in the matter. Tha appeal has no force and it is dismissed”

Validity of Individual Plastic Cards at All CGHS Wellness Centres in the country

Dear Comrades,
Now your CGHS Cards may valid through out the country i.e.valid at any CGHS wellness centres in the country.Department of Health and Family Welfare issued orders vide Memo No.6024/2007/CGHS(Hq)/CGHS(P) dated 16/03/2011. As per the above OM "Now that computerisation of all CGHS covered cities has been completed the plastic cards are valid in all CGHS cities in India and there is no need for obtaining temporary attachment while on a visit to another CGHS city.Since the data is available online CGHS beneficiaries are permitted to obtain medicines (including indented medicines) from any wellness centre located in the same city,where the card is registered or from any wellness centre located in any other CGHS city while on a visit (official as well as personal)"

Filling up of the posts of LSG in Accounts line in POs and RMS offices-Fresh Guidelines issued by the Directorate

Dear Comrades,
There is a lot of confusion while filling up of LSG (APM) Accounts line posts.There is no uniformity has been maintained in all the Circles while filling up of the said posts.In AP Circle also LSG Acounts line posts have not filled up by following the directorate guideline. CAT Chennai, CAT Ernakulam and even CAT Hyderabad (In Ranganatham V/S Union Of India case) also confirmed that LSG (A/Cs) cadre is divisionalised for limited purpose i.e. only for transfer liability and this cadre remains as a circle cadre and Posts have to be filled up according to their seniority in Accountants line i.e. year of passing of accountants examination only.After implementing the order of CAT Hyderabad, Now circle office is preparing a fresh LSG, HSG-II and HSG-I seniority list of Accounts line and the same will be out with in a month.Now the Directorate had issued afresh guidelines in this matter vide Memo No.06-12-2010-SPB-II dated 07/03/2011

Clarification regarding reimbursment of LTC-80 fare-Fresh order issued by the Finance Ministry

Dear Comrades,
A clarification regarding reimbursement of LTC-80 fares issued by the Finance Ministry vide memo No.19024/1/2009-E.IV dated 04/03/2011. The same is placed here for the information of the members.
As per the clarification "It is clarified that reimbursement of air fare lower than the LTC-80 air fare of Air India will also be admissible for journeys performed by Air India under LTC as the intention is to ensure that the LTC claim should not in any case, exceed LTC-80 fate of Air India"
